RESOLUTION 1371 A RESOLUTION AFFIRMING THE COMMITMENT TO SUPPORTING ELECTRICAL VEHICLE ADOPTION WHILE OPTING OUT OF THE COLORADO EV CHARGER PERMITTING MODEL CODE AND OTHER STATE STANDARDS THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO, HEREBY FINDS AND RECITES THAT: WHEREAS, Boulder was among the first jurisdictions in the country to support electric vehicle (EV) adoption by requiring that EV charging infrastructure be provided with all new building construction; and WHEREAS, on September 15, 2020, Boulder City Council declared Boulder a GoEV City, pledging to electrify the transportation sector and affirming commitment to implementations of policies, programs and regulations that support EV adoption; and WHEREAS, for more than a decade, the city has worked to remove barriers to installation of EV charging infrastructure; and WHEREAS, applications for EV charging infrastructure have consistently been efficiently reviewed and approved in Boulder under its current land use and building code standards and processes; and WHEREAS, the city remains committed to establishing policies and programs that conserve energy, promote sustainability, and support Colorado’s goal of nearly one million EVs on its roads by 2030, which may include future review and updates to Boulder land use code standards and processes related to EV charging infrastructure; and WHEREAS, the city remains committed to programs, policies, incentives, and regulatory approaches to transition 30% of all vehicles within the city to zero emissions by 2030, and 100% of all vehicles by 2050; and WHEREAS, in the spirit of intergovernmental cooperation and partnership, the city desires to assist the Colorado Energy Office by indicating its intent to follow its existing permitting review process for electric vehicle (“EV”) charging system applications in response to C.R.S. § 31‐23‐316(2).

NOW
THEREFORE,
BASED
ON
THE
FINDINGS
MADE
IN
THIS
RESOLUTION, ABOVE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO, THAT: 1. Section 1. The Boulder Revised Code (B.R.C. 1981) and other ordinances of the City of Boulder provide sufficient and reasonable standards and processes for the review and permitting of applications for EV charging systems. 2. Section 2. The City of Boulder will continue to use its existing permitting review processes for applications for EV charging systems and, at this time, does not intend to adopt the EV Charger Permitting Model Code or other standards and processes provided by C.R.S. §31‐23‐316. 3. Section 3. The City Council directs the city manager to, on or before March 1, 2026, submit a copy of this Resolution to the Colorado Energy Office.
