AN ORDINANCE VACATING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF VACATION FOR A PORTION OF COLORADO AVENUE RIGHT-OFWAY LOCATED NORTH OF 1100 28TH STREET, AND SETTING FORTH RELATED DETAILS.

THE CITY COUNCIL OF THE CITY OF BOULDER FINDS AND RECITES THAT:

A. 1100 28th Street Owner, LLC, a Delaware limited liability company, the owner of the

property located at 1100 28th Street, Boulder, CO, has requested that the city vacate a portion of

Colorado Avenue right-of-way located north of 1100 28th Street; and B. The City Council is of the opinion that the requested vacation is in the public interest and that said right-of-way is not necessary for the public use. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO: Section 1. The City Council vacates and authorizes the city manager to execute a deed of vacation for a portion of Colorado Avenue right-of-way as conveyed to the City of Boulder in the Warranty Deed recorded in the records of the Boulder County Clerk and Recorder

at Book 1270 at Page 240 on the 11th day of March, 1963, more particularly described in

Exhibit A, attached, reserving an easement interest for the installation, construction, repair,

maintenance and reconstruction of utilities and appurtenances thereto, together with all rights

and privileges as are necessary or incidental to the reasonable and proper use of such easement in and to, over, under and across the real property described in Exhibit A . Section 2. This ordinance is necessary to protect the public health, safety and welfare of the residents of the city and covers matters of local concern.

Section 3. The City Council deems it appropriate that this ordinance be published by title

only and orders that copies of this ordinance be made available in the office of the city clerk for
