AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF BOULDER AT THE REGULAR MUNICIPAL COORDINATED ELECTION TO BE HELD ON TUESDAY NOVEMBER 3, 2026, THE QUESTION OF AUTHORIZING AN AMENDMENT OF THE BOULDER HOME RULE CHARTER TO MODIFY THE CALCULATION OF THE CITY’S DEBT LIMITATION, AS SET FORTH IN THE BALLOT; SPECIFYING THE FORM OF THE BALLOT AND OTHER ELECTION PROCEDURES; AND SETTING FORTH RELATED DETAILS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO:
11 Section 1. A regular municipal coordinated election will be held in the city of Boulder,

County of Boulder, and State of Colorado, on Tuesday November 3, 2026.

Section 2. At that election, a question shall be submitted to the electors of the city of Boulder entitled by law to vote that will allow voters to consider authorizing an amendment of Section 97 of the Boulder Home Rule Charter to modify the calculation of the city’s debt limitation from three percent (3%) of the assessed valuation of the taxable property within the city to three percent (3%) of the actual value of the taxable property within the city. Sec. 97. – Limitation of city indebtedness.

The city shall not become indebted for any purpose or in any manner to any amount which, including existing indebtedness, shall exceed three percent of the assessed valuation actual value of the taxable property within the city, as shown by the last preceding assessment for city purposesannually determined by the Boulder county assessor based on a biennially recalculated “level of value” set on January 1 of each odd-numbered year; provided, however, that in determining the limitation of the city's power to incur indebtedness there shall be included only those bonds or other indebtedness payable solely from the proceeds of ad valorem taxes. Bonds or other securities payable in whole or in part from revenue to be derived from water, sewer, electric light and power, gas, or other public utilities, projects, enterprises, works, or ways from which the city will derive the revenue, or from sales, use, or other excise taxes, or from franchise fees or taxes, or from any other fees and charges shall not be included in determining the outstanding indebtedness of the city. Such revenue bonds or other securities may be additionally secured by a pledge of the full faith and credit of the city without being required to be included in such computation of indebtedness.

Section 4. This Ordinance is necessary to protect the public health, safety, and welfare of the residents of the city, and covers matters of local concern. Section 5. The City Council deems it appropriate that this Ordinance be published by title only and orders that copies of this Ordinance be made available in the office of the city clerk for public inspection and acquisition.
