THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO, FINDS AND RECITES THE FOLLOWING: A.

The City of Boulder, Colorado (“City”) is a home rule city in the State of

Colorado. B.

authority and power of eminent domain. D.

On August 29, 2018, the City Council accepted the East Arapahoe/CO 7

17

Transportation Plan (“EATP”), setting the multi-modal vision for Boulder’s East Arapahoe/State

18

Highway 7 corridor. The Arapahoe Avenue Safety Improvements Project fulfills a segment of

19

the EATP multi-modal improvements adjacent to and approaching Arapahoe Avenue between

20

28th Street and 38th Street (“Project”) with the following improvements:

21

i.

Continuous multi-use paths and raised protected bike lanes for people walking, rolling, and biking separated from vehicle traffic;

ii.

iii.

Maintaining two general-purpose traffic lanes and the bus lane in each direction.

E.

The City Council has determined that there is a need and necessity to acquire

The property interests (“Property Interests”) sought to be acquired for the Project

includes the properties purportedly owned by the persons or entities (“Property Owners”) as described in Exhibit A, attached hereto and incorporated herein by this reference. G.

The City Council finds and determines that City staff, consultants, or agents are

authorized to commence or continue good faith negotiations for the acquisition of the Property Interests with the Property Owners and to make good faith offers for the Property Interests. H.

The City Council finds and determines that if the Property Interests cannot be

obtained voluntarily, the City, by and through City staff, consultants, or agents, is authorized to

14

use its power of eminent domain to commence condemnation proceedings to acquire the

15

Property Interests and prosecute the proceedings to conclusion.
