AN ORDINANCE VACATING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF VACATION FOR A PORTION OF BERNOULLI BLVD. RIGHT-OF-WAY, CITY OF BOULDER, COUNTY OF BOULDER, COLORADO, GENERALLY LOCATED NORTH OF 3200 AIRPORT RD., AND SETTING FORTH RELATED DETAILS.

THE CITY COUNCIL OF THE CITY OF BOULDER FINDS AND RECITES THAT: A. The County of Boulder, a body politic and corporate of the State of Colorado, the owner of the property generally known as 3200 Airport Rd., Boulder, CO, known as Boulder

County Jail, and more particularly descried as Lot 1, Airport South, City of Boulder, County of

Boulder, State of Colorado, has requested that the city vacate a portion of Bernoulli Blvd. right-

of-way located within the Airport South Subdivision; and B. The City Council is of the opinion that the requested vacation is in the public interest and that said right-of-way is not necessary for the public use. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO: Section 1. The City Council vacates and authorizes the city manager to execute a deed of vacation for a portion of Bernoulli Blvd. right-of-way as dedicated to the City of Boulder on the Airport South Subdivision plat recorded in the records of the Boulder County Clerk and

Recorder at Film No. 1431, Reception No. 791027 on September 22nd, 1986, more particularly

described in Exhibit A, attached and reserving an easement for access to and the installation,

construction, repair, maintenance and reconstruction of utilities and appurtenances to such

utilities, together with all rights and privileges as are necessary or incidental to the reasonable and proper use of such easement in and to, over, under and across the real property described in Exhibit A attached hereto.

No permanent structure or improvement shall be placed or authorized to be placed on said

easements by the present owner of the subservient land or its successors and assigns, and the use

of such easements shall not otherwise be obstructed or interfered with. Section 2. This ordinance is necessary to protect the public health, safety, and welfare of

the residents of the city, and covers matters of local concern.

Section 3. The City Council deems it appropriate that this ordinance be published by title

8

only and orders that copies of this ordinance be made available in the office of the city clerk for

9

public inspection and acquisition.
