DEED OF VACATION The City of Boulder, Colorado, does hereby vacate and release to the present owners of the subservient land, in the manner prescribed by Section 43-2-302, C.R.S., and Section 8-6-9, B.R.C. 1981, Ponca Place right-of-way previously dedicated to the City of Boulder and recorded in the records of the Boulder County Clerk and Recorder at Reception No. (90)617410 on August 26, 1958, located adjacent to 350 and 355 Ponca Pl., and more particularly described in Exhibit A attached hereto and incorporated herein by reference. Notwithstanding the foregoing, the City reserves an easement for the installation, construction, repair, maintenance and reconstruction of utilities and appurtenances thereto, together with all rights and privileges as are necessary or incidental to the reasonable and proper use of such easement in and to, over, under and across the real property described in Exhibit B attached hereto and incorporated herein by reference. No permanent structure or improvement shall be placed or authorized to be placed on said easement by the owner of the subservient land or its successors and assigns, and the use of such easement shall not otherwise be obstructed or interfered with. The above right-of-way vacation and release of said right-of-way located adjacent to 350 and 355 Ponca Pl. shall extend only to the portion of right-of-way specifically vacated. The within vacation is not to be construed as vacating any rights-of-way, easements or cross-easements lying within the description of the vacated portion of right-of-way.
