AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF BOULDER AT THE REGULAR MUNICIPAL COORDINATED ELECTION TO BE HELD ON TUESDAY NOVEMBER 3, 2026, THE QUESTION OF RAISING TAXES IN THE CITY OF BOULDER BY THE ADOPTION OF A VACANCY EXCISE TAX IMPOSED ON HOMES THAT ARE OCCUPIED FOR 183 DAYS OR LESS PER YEAR, WITH SUCH AMOUNT TO INCREASE ANNUALLY IN ACCORDANCE WITH THE DENVER-AURORA-LAKEWOOD CONSUMER PRICE INDEX TO SUPPORT GENERAL CITY SERVICES; SPECIFYING THE FORM OF THE BALLOT AND OTHER ELECTION PROCEDURES; AND SETTING FORTH RELATED DETAILS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO:

Section 1. A regular municipal coordinated election will be held in the city of Boulder, County of Boulder, and State of Colorado, on Tuesday November 3, 2026.

Section 2. At that election, a question shall be submitted to the electors of the city of Boulder entitled by law to vote that will allow voters to consider whether to raise taxes to support general city services through the adoption of a vacancy excise tax imposed on homes

that are occupied for 183 days or less per year, with such tax to be imposed beginning January 1,

2028, and to increase annually in accordance with the local consumer price index.

Section 3. The official ballot shall contain the following ballot title, which shall also be the designation and submission clause for the issue:

SHALL THE CITY OF BOULDER TAXES BE INCREASED $6,000,000 ANNUALLY (WHICH AMOUNT REPRESENTS ESTIMATED REVENUES IN 2028, THE FIRST FULL FISCAL YEAR OF COLLECTION), AND BY SUCH AMOUNTS RAISED ANNUALLY THEREAFTER, BY IMPOSING A $4,000 TAX ON VACANT HOMES THAT ARE OCCUPIED FOR 183 DAYS OR LESS PER YEAR, WITH SUCH AMOUNT NEVER FALLING BELOW $4,000 BUT INCREASING ANNUALLY IN ACCORDANCE WITH THE DENVER-AURORA-LAKEWOOD CONSUMER PRICE INDEX UP TO, BUT NEVER EXCEEDING $7,000, WITH THE REVENUE FROM SUCH TAX TO BE USED FOR THE PURPOSE OF SUPPORTING CITY SERVICES, INCLUDING: POLICE AND FIRE PROTECTION; PARKS AND RECREATION; TRANSPORTATION AND MAINTENANCE; AND OTHER GENERAL SERVICES IMPORTANT TO THE QUALITY OF LIFE IN THE CITY;

AND SHALL THE REVENUES FROM SUCH TAXES AND ANY RELATED EARNINGS BE COLLECTED, RETAINED, AND SPENT AS A VOTER-APPROVED REVENUE CHANGE WITHOUT LIMITATION AND AN EXCEPTION TO THE REVENUE AND SPENDING LIMITS OF ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION?

Section 4. If a majority of all the votes cast on the measure at the election are for the

measure, the measure shall be deemed to have passed, and the City Council will adopt a new

chapter in the Boulder Revised Code 1981 to implement this tax by its January 1, 2028, commencement date.

Section 5. This Ordinance is necessary to protect the public health, safety, and welfare of the residents of the city, and covers matters of local concern.

Section 6. The City Council deems it appropriate that this Ordinance be published by

title only and orders that copies of this Ordinance be made available in the office of the city clerk

for public inspection and acquisition.
