AN ORDINANCE AMENDING ORDINANCE 7459 EXPANDING THE WESTERN MOUNTAIN PARKS HABITAT CONSERVATION AREA TO ADD THE SOUTHERN PORTIONS OF THE 90 ARAPAHOE AND 96 ARAPAHOE PROPERTIES TOTALING APPROXIMATELY THREE ACRES, PURSUANT TO SECTION 8-8-2, “HABITAT CONSERVATION AREA DESIGNATION,” B.R.C. 1981; AND SETTING FORTH RELATED DETAILS.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO: Section 1. Purpose and Findings. (a)
The purpose of this ordinance is to implement the policies and recommendations
approved by city council in the 2005 OSMP Visitor Master Plan (VMP) criteria for inclusion in an HCA Management Area Designation (MAD) and the 2019 OSMP Master Plan. This ordinance is subject to referendum as provided in the City Charter. (b)
Ordinance 7459 designated Southern Grasslands as a Habitat Conservation Area.
The Southern Grasslands Habitat Conservation Area was then expanded by Ordinances 7616,

7899, and 8099.

(c)
Pursuant to Section 8-8-2, “Habitat Conservation Area Designation,” B.R.C 1981,

the city manager has identified and proposed the areas described in this ordinance for restricted
22
public use because the area would appropriately constitute a habitat conservation area within the
23
city’s open space and mountain parks system based upon the criteria set forth in the Open Space
24
and Mountain parks Visitor Master Plan.

Space Board of Trustees on the areas included in this ordinance.

Section 2. Council hereby amends Ordinance 7459 to order the designation of Depoorter II property totaling approximately two acres.

Section 3. This ordinance is necessary to protect the public health, safety, and welfare of the residents of the city and covers matters of local concern.

Section 4. The city council deems it appropriate that this ordinance be published by title only and orders that copies of this ordinance be made available in the office of the city clerk for public inspection and acquisition.

The city manager has sought and received advice and comments from the Open
