AN ORDINANCE AMENDING CHAPTER 10-10, B.R.C. 1981, BY ADDING A NEW SECTION 10-10-3, “PROHIBITION ON THE INSTALLATION AND USE OF GRAYWATER TREATMENT WORKS,” PROHIBITING GRAYWATER USE BY PERSONS SERVED THROUGH THE CITY’S WATER UTLITY; AND SETTING FORTH RELATED DETAILS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER,

Section 1. A new Section 10-10-3, “Prohibition on the Installation and Use of Graywater Treatment Works,” B.R.C. 1981, is added to read as follow:

Section 10-10-3. - Prohibition on the Installation and Use of Graywater Treatment Works. (a)

No person served with water through the city’s water utility shall install graywater treatment works or use graywater.

(b)

“Graywater” means that portion of wastewater that, before being treated or combined with other wastewater, is collected from fixtures within residential, commercial, or industrial buildings or institutional facilities for the purpose of being put to beneficial uses.

(c)

“Graywater treatment works” means an arrangement of devices and structures used to:

collect graywater from within a building or facility; and treat, neutralize, or stabilize graywater within the same building or facility to the level necessary for its authorized uses.

Violation. In addition to any other applicable remedy at law or in equity, violations of this Section may be prosecuted, and the penalties in Section 5-2-4, “General Penalties,” B.R.C. 1981 apply. This Section shall not be construed as to require administrative proceedings before such criminal action.

Section 2. This Ordinance is necessary to protect the public health, safety, and welfare

of the residents of the city and covers matters of local concern. Section 3. The City Council deems it appropriate that this Ordinance be published by

title only and orders that copies of this Ordinance be made available in the office of the city clerk

for public inspection and acquisition.
