Section 2. Section 3-20-2, “Imposition and Rate of Rental License Excise Tax,” B.R.C.

3-20-2. Imposition and Rate of Rental License Excise Tax.

There is levied and shall be paid and collected an excise tax of $80.71 $78.90 per year for each dwelling unit that is required to get a rental license by the city, unless it is exempt from the tax by Section 3-20-5, “Exemptions,” B.R.C. 1981.

Section 3. Chapter 4-20, “Fees,” B.R.C. 1981, is amended to read as follows: 4-20-3. Auctioneer License Fees. An applicant for an auctioneer license shall pay the following fees at time of application: (1) an application fee of $75 $25, (2) an annual license fee of $87 $84.50, and (3) a $10 $7 per person fee submitted for background check review. Application fees are non-refundable. License fees are refundable if an application is denied or withdrawn. 4-20-4. Building Contractor License, Building Permit Fees, and Payment of Estimated Use Tax. An applicant for a contractor in the public right of way right-of-way license shall pay $201 per year.

An applicant for a permit for construction in the public right of way, for improvements which are, or will become, through construction acceptance, owned and operated by the city, shall pay the following fees: (1)

(D)

$144 $122 for one square yard through three hundred square yards plus $0.41 $0.35 per square yard over three hundred square yards of concrete or asphalt to be constructed and inspected for new or overlaid street, parking, or alley sections;

An applicant for a permit for placement in the right of way of temporary construction equipment or materials, including but not limited to construction Dumpsters, construction fencing, heavy equipment (not including cranes) or cranes, scaffolding or covered walkways, for a single project on adjacent private property, not in association with the construction of public improvements within the right of way, shall pay the base permit fee plus $94 $81.50. For cranes, this fee shall be $250. Such a permit shall be approved only when the applicant can demonstrate that placement of the temporary construction equipment or materials outside of the right of way is not feasible, and feasible and shall be effective for a time period not to exceed the more restrictive of: a) the authorized time frame in the permit conditions, or b) thirty days. After the authorized time frame or thirty days have expired, the applicant shall either remove the temporary construction equipment or materials or obtain a new permit to allow the temporary construction equipment or materials to remain in the right of way for the duration of the new permit, which shall not exceed thirty days.

An applicant for a permit for construction in the public right of way of improvements to utilities which are not owned or operated by the city shall pay the following fees:

Permit Utility construction

An applicant for a utility permit shall pay the following additional fee: Fee $78 $67.50

An applicant for a permit to excavate an area in the pavement of any public street or alley with surface paving less than three years old as set forth in Section 8-5-13, “Construction and Restoration Standards for Newly Constructed or Overlayed Streets,” B.R.C. 1981, shall pay an impact fee for loss of useful pavement life of $4.00 $3.85 per square foot of paved surface area removed during excavation.

(j)

An applicant for a permit to work in the public right of way that includes closure or alteration of a transportation facility for more than twenty-four hours and for which a traffic control plan is required pursuant to Section 8-5-10, “Temporary Traffic Control,” B.R.C. 1981, shall pay a traffic control inspection fee as follows:

An applicant for a permit to construct a stormwater detention or stormwater quality facility required by Paragraph 11-5-6(b)(4), B.R.C. 1981, shall pay a fee of $831 $718 per facility.

An applicant for a permit to connect to the stormwater utility system in accordance with Section 11-5-4, “Connections to the Stormwater Utility System,” B.R.C. 1981, shall pay:

An inspection fee (first two inspections inclusive) of $196 $169. Each subsequent inspection is $109 $94.

4-20-10. Itinerant Merchant License Fee.

An applicant for an itinerant merchant license shall pay the following fees at time of application: (1) an application fee of $50 $25, (2) a license fee of $51$49.50 per 12-month period, and (3) a $10 $7 per person fee submitted for background check review. Application fees are non-refundable. License fees are refundable if an application is denied or withdrawn.

4-20-11. Mall License and Permit Fees.

The following fees shall be paid before issuance of a revocable permit or lease, kiosk, mobile vending cart, ambulatory vendor, entertainment vending, personal services vending, or animal permit, and rental of advertising space on informational kiosks:

An applicant for an encroachment for a telecommunication conduit crossing as set forth in Subsection 8-6-6(j), “Leases for Point-to-Point Telecommunication Conduit Crossings,” B.R.C. 1981, shall pay $21.81 $21.20 per lineal foot of the conduit crossing per year.

Owners of all parcels of land in the city submitting building permit applications shall pay a stormwater and flood management plant investment fee based on the square feet of added impervious area. However, if new stormwater detention facilities are built by the owner according to the most current City of Boulder Design and Construction Standards in effect at the time the building permit application is submitted, on or after April 2, 2009, the applicable fee shall be reduced by fifty percent.

4-20-49. Neighborhood Parking Permit Fee.

(a)

A zone resident applying for a neighborhood parking permit shall pay $53.00 $51.50 for each permit or renewal thereof, except that a resident of the Chautauqua North neighborhood zone shall instead pay $11.00 $10.50.

(b)

A resident of a neighborhood permit parking zone may purchase a Flex permit for $53.00 up to two annual visitor permits at $5 for each permit.

(c)

A business applying for a neighborhood parking permit for employees shall pay $79 $77 for each permit or renewal thereof.

(d)

An individual who does not reside within the zone applying for a neighborhood parking permit, if permitted in the zone, shall pay $40.50 $39.50 for each monthly commuter permit or renewal thereof.

(e)

A contractor applying for a temporary permit shall pay $5 for each permit and such permit(s) shall be valid for one month.

(f)

A contractor applying for a mobile vendor permit shall pay $77.25 $75 for each annual permit or renewal thereof.

(g)

A resident issued a permit may obtain two two-week guest permits per year at no cost with an option to purchase up to ten more at a cost of $5 for each permit.

4-20-66. Mobile Food Vehicle Sales.
