Draft Motion Language Staff requests council consideration of this matter and action in the form of the following motion: Motion to approve the order of the City of Boulder ballot measures and City Council Candidates for the November 3, 2026, General Municipal Coordinated Election as proposed by the City Clerk.
Executive Summary The purpose of this item is to establish the order of City of Boulder ballot measures for the November 3, 2026, General Municipal Coordinated Election in compliance with state statutes and Colorado Secretary of State Rules. Those rules require referred TABOR
measures (Issues) to be listed first, in the order of (a) increasing taxes, (b) retaining excess revenues, and (c) increasing debt. Referred non-TABOR measures (Questions) are listed next. Referred measures are identified by the number designated for a municipality then a letter that will be assigned by the County (2X). Initiated measures are identified by a number only (municipal measures are 300-399). Historically, council has put optional short titles onto the ballot in addition to the full ballot title. The short titles have been less than 10 words and serve as an additional identifier of the ballot measure. The short titles are listed below next to each ballot measure. Ballot Measures The following ballot measures were adopted at the August 6, 2026, regular meeting of the Boulder City Council: 1. Adoption of a Vacancy Excise Tax imposed on homes that are occupied for 183 days or less per year (Ord. 8759) – Residential Vacancy Excise Tax. 2. Amending the Boulder Home Rule Charter to add a new Section 73, “Collective Bargaining for Firefighters (Ord. 8761) – Bargaining Rights Union Firefighters in City Charter,” 3. Amending the Boulder Home Rule Charter to modify the calculation of the city’s debt limitation (Ord 8762) – Debt Limit Charter Change. Ordinance 8758 - Authorizing the issuance of general obligation bonds for the purpose of financing community recreation, safety infrastructure, and other capital projects, was amended and passed on second reading at the August 6, 2026 meeting and the third reading and adoption was held at the August 20, 2026 Meeting.
The City Clerk recommends the ballot order be as follows: • • • •
Ballot Issue 2X (TABOR) – Residencial Vacancy Excise Tax Ballot Issue 2X (TABOR) – Recreation and Safety Bond Ballot Question 2X – Bargaining Rights Union Firefighters in City Charter Ballot Question 2X – Debt Limit Charter Change
The council candidates will be listed in the following order, per Charter Sec. 34:

The city is required to submit the ballot order to the Boulder County Clerk and Recorder on Sept. 4, 2026.
Council Action Options Option Approve motion language as drafted
Outcome If the motion is approved, the City Clerk will transmit the ballot order to the Boulder County Clerk and Recorder as required on September 4, 2026.
Define and adopt a modified motion
Council would need to define any modifications or amendments to the draft motion language. If amendments are made; Council would be requested to approve the order as amended. This will ensure the ballot order is transmitted to the Boulder County Clerk on the required date.
Deny the motion or take no action
If this motion is denied, the ballot order cannot be certified to the County Clerk.
Refer back to staff
If council refers this item back to staff, the ballot order will not be certified in time to transmit the ballot order to the County Clerk.
