DEED OF VACATION The City of Boulder, Colorado, does hereby vacate and release to the present owner of the subservient land, in the manner prescribed by Section 43-2-302, C.R.S., and Section 8-6-9, B.R.C. 1981, a 0.03-acre portion of Marine Street right-of-way located adjacent to 2106 and 2130 Arapahoe Ave., and more particularly described in Exhibit A attached hereto and incorporated herein by reference. Notwithstanding the foregoing, the City reserves easements for the following purposes in and to, over, under and across the real property described in Exhibit B attached hereto and incorporated herein by reference, together with all rights and privileges as are necessary or incidental to the reasonable and proper use of such easements: 1) A public access easement for the purposes of ingress and egress, and the installation, construction, repair, maintenance and reconstruction of transportation improvements, landscaping, and utilities and appurtenances thereto; and 2) A utility easement for the installation, construction, repair, maintenance and reconstruction of utilities and appurtenances thereto. No permanent structure or improvement shall be placed or authorized to be placed on said easements by the owner of the subservient land or its successors and assigns, and the use of such easements shall not otherwise be obstructed or interfered with. The above right-of-way vacation and release of said right-of-way located adjacent to 2106 and 2130 Arapahoe Ave. shall extend only to the portion of right-of-way specifically vacated. The within vacation is not to be construed as vacating any rights-of-way, easements or cross-easements lying within the description of the vacated portion of right-of-way.
