Agenda Title Consideration of a Landmark Alteration Certificate application to construct a new approximately 800 square foot accessory building at 409 Mountain View Rd. (HIS202600035) a non-contributing property in the Mapleton Hill Historic District, pursuant to Section 9-11-18 of the Boulder Revised Code 1981 and under the procedures prescribed by chapter 1-3, “Quasi-Judicial Hearings,” B.R.C. 1981.

Executive Summary The purpose of this item is for City Council to review the Landmarks Board’s decision to conditionally approve a Landmark Alteration Certificate application. At its April 8, 2026 meeting, the Landmarks Board conditionally approved a Landmark Alteration Certificate application to construct a new approximately 800 square foot accessory building at 409 Mountain View Rd. (HIS2026-00036) a non-contributing property in the Mapleton Hill Historic District. The board’s conditional approval is subject to a 16-day call-up period by City Council, no later than April 24, 2026. However, the 16-day call-up period cannot be met because the next regularly scheduled City Council meeting is on May 7, 2026. The City Manager’s approval of an extension is included as Attachment A.

Landmarks Board History On Feb. 10, 2026, the Planning & Development Services Dept. accepted an LAC application to construct a new two story, approximately 800 square foot accessory building. Section 9-11-14(b), B.R.C. 1981 requires review in a public hearing for demolition and new construction over 340 sq. ft. On April 8, 2026, the Landmarks Board voted (5-0) to adopt the staff memorandum as the findings of the board and conditionally approve the application for a Landmark Alteration Certificate to construct a new approximately 800 square foot accessory building at 409 Mountain View Rd. (HIS2026-00035) a non-contributing property in the Mapleton Hill Historic District, finding that the proposal meets the Standards for Issuance of a Landmark Alteration Certificate in Chapter 9-11-18, B.R.C. 1981 and is consistent with the General Design Guidelines, provided the stated conditions are met. Conditions of Approval: 1. The applicant shall be responsible for completing the work in compliance with the approved plans, except as modified by these conditions of approval. 2. Prior to submitting a building permit application and final issuance of the Landmark Alteration Certificate, the applicant shall submit the following, which shall be subject to final review and approval by the Landmarks Design Review Committee to ensure that the final design is consistent with the General Design Guidelines and the Mapleton Hill Historic District Guidelines and the intent of this approval: a. Explore revisions to the use of horizonal metal siding materiality on the flat roof portion to reflect materiality of house and addition.

b. Revise design of person door on the west elevation to a traditionally sized door with a transom window above. c. Provide details of lighting locations, guttering, materiality of the railing, pathway and hardscaping, steps and alley apron, and fence including details of type, material and color proposed. Materiality of pathway and hardscaping, steps, and driveway apron should demonstrate permeability and compatibility in scale, proportion, texture and finish to those used historically. d. Provide details of fencing proposed including non-combustible material within 8 feet of a structure, height, style, spacing and finish.

Analysis – Alignment with Relevant Portions of Boulder Revised Code The decision was based upon the board’s consideration that the proposal generally meets the Standards for Issuance of a Landmark Alteration Certificate in Chapter 9-1118, B.R.C. 1981.

Fiscal Note Review of this project is part of the P&DS team’s standard workplan and its impacts are incorporated into the annual revenue forecasting as part of the Budget office’s annual budget development. Therefore, review of the project will not have a meaningful fiscal impact past what has already been included in the approved budget.

Next Steps for City Council The City Council may call up the application. If the application is called up, the City Council will be the decision-maker on the application. Called-up item will be scheduled for a public hearing within 45 days after the date of a decision by the Landmarks Board. If the application is not called up, the Landmarks Board’s approval is final.
