AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF BOULDER AT THE REGULAR MUNICIPAL COORDINATED ELECTION TO BE HELD ON TUESDAY, NOVEMBER 3, 2026, THE QUESTION OF AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS FOR THE PURPOSE OF FINANCING COMMUNITY RECREATION, SAFETY INFRASTRUCTURE, AND OTHER CAPITAL PROJECTS; SPECIFYING THE FORM OF THE BALLOT AND OTHER ELECTION PROCEDURES; AND SETTING FORTH RELATED DETAILS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO: Section 1. A regular municipal coordinated election will be held in the city of Boulder, County of Boulder, and State of Colorado, on Tuesday November 3, 2026.

Section 2. At that election, a question shall be submitted to the electors of the city of

Boulder entitled by law to vote that will allow voters to consider authorizing the issuance of
17
general obligation bonds (the “Bonds”), the proceeds of which are to be used for community
18
recreation, safety infrastructure, and other capital projects as approved by City Council, which
19
Bonds shall be repaid from an ad valorem mill levy that will expire at the time the Bonds retire.

Section 3. The official ballot shall contain the following ballot title, which shall also be the designation and submission clause for the issue:

SHALL CITY OF BOULDER DEBT BE INCREASED UP TO $400,000,000, WITH A MAXIMUM REPAYMENT COST UP TO $650,000,000, AND SHALL CITY TAXES BE INCREASED UP TO $32,500,000 ANNUALLY FOR THE PURPOSE OF FINANCING THE CONSTRUCTION, RENOVATION, OR REPLACEMENT OF COMMUNITY RECREATION, SAFETY INFRASTRUCTURE, AND OTHER CAPITAL PROJECTS, SUCH AS:

THE SOUTH BOULDER RECREATION CENTER, INCLUDING AQUATICS AMENITIES; THE NORTH BOULDER RECREATION CENTER, INCLUDING ACQUATICS AMENITIES AND IMPROVEMENTS NEEDED TO CO-LOCATE WEST AGE WELL SENIOR CENTER; FIRE STATIONS (TO SUSTAIN EMERGENCY AND WILDFIRE RESPONSE CAPABILITIES); A NEW PUBLIC SAFETY BUILDING FOR POLICE AND 911 SERVICES; PENFIELD TATE II MUNICIPAL BUILDING; AND THE MUNICIPAL SERVICE CENTER (TO SUPPORT INFRASTRUCTURE SERVICES, SUCH AS SNOW REMOVAL, UTILITY MAINTENANCE, AND CITY STREET OPERATIONS);
IN ORDER TO SUPPORT RECREATION, SAFETY, AND CRITICAL INFRASTRUCTURE NEEDS FOR COMMUNITY MEMBERS OF ALL AGES; THROUGH THE ISSUANCE AND PAYMENT OF GENERAL OBLIGATION DEBT, WITH SUCH DEBT CONTAINING SUCH TERMS, NOT INCONSISTENT HEREWITH, AS THE CITY COUNCIL MAY DETERMINE; AND IN CONNECTION THERWITH, SHALL AD VALOREM PROPERTY TAXES BE LEVIED WITHOUT LIMITATION AS TO THE RATE, BUT NOT MORE THAN THE AMOUNTS LISTED ABOVE, TO GENERATE AN AMOUNT SUFFICIENT IN EACH YEAR TO PAY THE PRINCIPAL OF, PREMIUM, IF ANY, AND INTEREST ON SUCH DEBT OR ANY REFUNDING DEBT (OR TO CREATE A RESERVE FOR SUCH PAYMENT); AND

SHALL THE PROCEEDS OF SUCH DEBT AND RESERVES AND THE REVENUES FROM SUCH TAXES AND ANY INVESTMENT INCOME EARNED FROM SUCH PROCEEDS AND REVENUES BE COLLECTED AND SPENT WITHOUT LIMITATION OR CONDITION AS A VOTER-APPROVED REVENUE CHANGE AND AN EXCEPTION TO THE LIMITS THAT WOULD OTHERWISE APPLY UNDER ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION OR ANY OTHER LAW?

7 Section 4. If a majority of the votes cast on the measure at the election are in favor of the

measure, the City Council shall be authorized to proceed with the necessary action to issue the
10
Bonds and/or levy taxes in accordance with the approved ballot measure. The City Council shall
11
be authorized to determine the terms of the Bonds and the projects to be financed with Bond
12
proceeds, in accordance with the terms of this Ordinance and the ballot measure so authorized by
13
city voters. As of the date hereof, City Council plans to utilize authorized Bond proceeds for the
14
following projects:

Replacing of the South Boulder Recreation Center, including aquatics amenities; Renovating the North Boulder Recreation Center, including aquatics amenities and improvements needed to co-locate West Age Well Senior Center; Repairing and renovating fire stations (to sustain emergency and wildfire response capabilities); Constructing a new public safety building for police and 911 services; Renovating the Penfield Tate II Municipal Building; and Renovating portions of the Municipal Service Center (to support infrastructure services, such as snow removal, utility maintenance, and city street operations).

Section 5. This Ordinance is necessary to protect the public health, safety, and welfare of the residents of the city, and covers matters of local concern.

Section 6. The City Council deems it appropriate that this Ordinance be published by

title only and orders that copies of this Ordinance be made available in the office of the city clerk

for public inspection and acquisition.
