Executive Summary The purpose of this item is to amend Titles 7, 9, and 10 to address miscellaneous topics, such as fixing errors, simplifying language or code organization, and addressing issues that have emerged after a few years of implementing previous ordinances. On May 7, 2026, the City Council held a public hearing and discussed Ordinance 8745. Council action was to amend and pass Ordinance 8745 on second reading, with an
amendment to remove size restrictions for outdoor patios of taprooms, tasting rooms, and breweries/distilleries/wineries with restaurants as outlined in the staff presentation.

If the motion is approved, the ordinance would be adopted and would go into effect 30 days after the adoption date.

Council would need to define any desired modifications to the ordinance and/or to the draft motion language.

If this motion is denied or no action is taken, the ordinance would not be adopted, and no amendments would be made to Titles 7, 9, and 10 related to these topics.
Refer back to staff
If council refers this item back to staff for additional work, the ordinance would not be adopted, and other work plan item projects would need to be delayed to accommodate additional work on this omnibus code amendment.

Analysis The additional change requested by Council would remove outdoor seating from the size restrictions for taprooms, tasting rooms, and breweries, wineries, and distilleries with restaurants. While taprooms and tasting rooms would still be limited in size to ensure they are accessory to the brewery, winery, or distillery use, outdoor seating would not be included in the measurement. Outdoor seating is not typically included in size restrictions for other uses. This change is not anticipated to have negative impacts and will support these businesses providing the amenity of outdoor seating. The changes can be found in Attachment A, Subsection 9-6-5(b) and Section 9-16-1. All other changes in Ordinance 8745 are analyzed in the May 7, 2026 memo.

Next Steps for City Council If proposed Ordinance 8745 is finally adopted on May 21, it will go into effect on June 20, 2026. No further action would be necessary from Council.
