AN ORDINANCE VACATING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF VACATION FOR PONCA PLACE RIGHT-OF-WAY, CITY OF BOULDER, COUNTY OF BOULDER, COLORADO GENERALLY LOCATED ADJACENT TO 350 AND 355 PONCA PLACE, AND SETTING FORTH RELATED DETAILS.

THE CITY COUNCIL OF THE CITY OF BOULDER FINDS AND RECITES THAT: A. Frasier Meadows Manor Inc., a Colorado non-profit corporation, the owner of the property located at 350 Ponca Place, Boulder, CO, and Mountain View United Methodist

Church, a Colorado non-profit corporation, the owner of the property located at 355 Ponca

Place, Boulder, CO, have requested that the city vacate Ponca Place right-of-way located within

the Frasier Meadows Subdivision, City of Boulder, County of Boulder, State of Colorado; and B. The City Council is of the opinion that the requested vacation is in the public interest and that said public right-of-way is not necessary for the public use. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO: Section 1. The City Council vacates and authorizes the city manager to execute a deed of vacation for Ponca Place right-of-way as dedicated to the City of Boulder on the Frasier Meadows Subdivision plat recorded in the records of the Boulder County Clerk and Recorder at

Reception No. (90)617410 on the 26th day of August, 1958, more particularly described in

Exhibit A, attached, reserving an easement for the installation, construction, repair, maintenance

and reconstruction of utilities and appurtenances thereto, together with all rights and privileges as

No permanent structure or improvement shall be placed or authorized to be placed on said

easement by the present owner of the subservient land or its successors and assigns, and the use

of such easement shall not otherwise be obstructed or interfered with.
5 Section 2. This ordinance is necessary to protect the public health, safety, and welfare of

the residents of the city, and covers matters of local concern.

Section 3. The City Council deems it appropriate that this ordinance be published by title only and orders that copies of this ordinance be made available in the office of the city clerk for public inspection and acquisition.
