File: KH Adopted: August 14, 1986 Revised: February 25, 1993, May 24, 2005, November __, 2025 Associated Regulation KH-R PUBLIC GIFTS TO SCHOOLS AND THE SCHOOL DISTRICT The Superintendent and the Board of Education are appreciative of those who want to give gifts to the School District and its schools. The primary basis for these principles is the constitutional responsibility of the Board of Education to provide equal educational opportunity for all students.Any person or legal entity wishing to make a gift to the School District or to a particular school, or employee in the District shall submit to the Superintendent or designee a statement giving information relating to the nature of the gift and its proposed use. Gifts may include cash, real or personal property, services, or in-kind contributions. The School District reserves the right to accept or decline a proposed gift, based upon Board Policy and State and Federal law. No gifts or All outside funds received shall in no way improperly influence or dictate the direction of School District programs, nor hamper the objective administration or evaluation of School District programs, or obligate the Board of Education to continue initiatives or programs. . When outside funds are used to provide, maintain, or enhance school programs, the School District shall be under no obligation to continue the same level of programming in subsequent years or to support the programming if outside funds are discontinued or diminished. The basic principles of this policy apply to gifts to an individual school or schoolsponsored group and gifts to the School District. All gifts to be received by a school will be reviewed using the budget decision-making process at the school. Priorities for the use of gifts will be set in conformance with this policy and applicable conditions upon which a gift has been accepted by the School District. Basic Principles Governing Gifts to the School District 1. General gifts for equitable distribution to schools to be used for the benefit of students, including through the School District’s educational foundation, are encouraged. \ 2. Gifts for equipment or services that are not likely to be acquired from public funds are encouraged. 1

3. Gifts will not be used to substitute for regular funding requirements, but rather to enrich and supplement regular sources. 4. Gifts of property or services that involve significant costs for installation or maintenance, or initial or continuing financial commitments from School District funds, are discouraged. Principles Governing Gifts to Employ Personnel 1. Gifts to employ licensed regular or temporary personnel will be allowed for staff development that does not provide direct services to students and for occasional use of substitute teachers at the elementary and secondary levels. 2. Gifts to employ non-licensed regular or temporary personnel will be allowed, •

High schools using fund-raised dollars to employ non-licensed regular or temporary personnel shall be required to share ten (10) percent of the raised funds within the school community based on student need at the discretion of the principal. These decisions will be shown on the school’s annual budget. Elementary, middle and K-8 schools using fund-raised dollars to employ nonlicensed regular or temporary personnel shall be required to share ten (10) percent of the raised funds with the school district. The share shall be collected and redistributed to schools impacted by thirty (30) percent or greater free and reduced lunch (or other appropriate metric) in an amount proportionate to the schools’ total enrollment.

2.All applicable employment laws and procedures for posting, interviewing and hiring shall be followed. 3. Use of donated funds shall not alter the supervision and evaluation requirements applicable to the position, 4. Gifts to employ personnel for athletic coaches will not be allowed. Conversion of the School Resource Allocation to purchase regular and frequent staff must be approved by the level supervisors. 5.Supervision and evaluation of all staff hired from donated funds shall be under the direction of the principal. 2

6.4. Expenses related to the hiring of staff from donated funds shall be separated from other general operating fund positions and the use of shared 10% funds within and between schools shall be reported. in conformity with Policy File: KBE-R: Relations with Parent Organizations. 7.5. Funds supplied by a parent organization or fundraising effort shall be deposited into a revolving account under the school’s location code. All positions are limited to the expenditure of the deposited funds. All associated benefit expenses as defined by the School Ddistrict shall be covered by the donated funds. Gift Procedures All gifts, including those received by schools to employ personnel, must be reported annually in the end-of-year report for review by the District Accountability Committee and School District budget processes. Reporting shall include amounts, person or group donating, and the uses made of the gift. Gifts to the School District become the property of the District and are subject to the same controls and regulations that govern the use of all District-owned property. The Superintendent of Schools has the authority to accept gifts, consistent with the basic principles, which are of a value of less than $10,000.01. Gifts over $10,000.01 will be presented to and acted on by the Board of Education. The Superintendent or designee will develop and implement administrative guidelines and procedures that establish the clear and transparent format and procedures to be followed by potential donors to schools and the School District. When a gift has been accepted, it will become the property of the School District. Procedures will include the following: 1. Gifts of less than $1,000.00 to a single school, consistent with stated basic 3

principles as provided in this policy, will be accepted by the authority of the principal; gifts accepted under the authority of the building principal will be reported to the Superintendent. 2. Gifts in excess of $1,000.00 but less than $10,000.01 will be accepted by the authority of the Superintendent. 3. At the time of acceptance, there will be a definite understanding with regard to the use of the gift, including whether it is intended for the use of one particular school or all schools in the District. Reporting shall include amount or description of the gift, person or group donating, and the use made of the gift, including the name of the recipient staff member or group. USE OF GIFTS TO EMPLOY SCHOOL STAFF Gifts to employ non-licensed regular or temporary personnel will be allowed following Policy KH. Gifts to employ licensed regular or temporary personnel will be allowed only for those purposes as specified in Policy KH. • All gifts to employ school staff shall follow Policy File KH with respect to amounts and authority of acceptance. • Conversion of the School Resource Allocation to purchase regular and frequent staff must be approved by the level supervisors. • Expenses related to the hiring of staff from donated funds shall be separated from other general operating fund positions in conformity with Policy File: KBE-R: Relations with Parent Organizations. • Funds supplied by a parent organization or fundraising effort shall be deposited into a revolving account under the school’s location code.
