BOULDER VALLEY SCHOOL DISTRICT RE-2 RESOLUTION 26-18 On the Boulder Preparatory High School Charter School Renewal Application WHEREAS, the mission of the Boulder Valley School District is to create challenging, meaningful and engaging learning opportunities so that all children thrive and are prepared for successful, civically engaged lives; WHEREAS, on August 1, 1997, the School District and Boulder Preparatory High School entered into a Charter School Contract, that was subsequently amended by certain addenda (“Original Contract”); WHEREAS, the School District and Boulder Prep entered into Charter School Renewal Contracts in 2002, 2006, 2011, and 2016; WHEREAS, in December 2020, the School District’s Board of Education adopted Resolution 20-35 to extend the Boulder Prep Charter Contract for an additional year, through June 30, 2022; WHEREAS, Boulder Prep timely filed an application for renewal of the Charter Contract for a five-year term commencing July 1, 2022, through June 30, 2027; WHEREAS, real estate matters and additional negotiations delayed execution of an updated Contract; WHEREAS, at the request of the BVSD Board, Boulder Prep has timely filed an updated application for renewal of the Charter Contract for a five year term commencing July 1, 2026; and, WHEREAS, the School District’s Board of Education (“Board”) has determined that the Renewal Application complied with the purposes and requirements of the Charter Schools Act specifically addressing the intent of the Act that a certain number of charter schools serve the needs of at-risk students; and WHEREAS, Boulder Prep has achieved pupil performance standards, responsibly managed its funds, and met all other goals, objectives, content standards, applicable Federal requirements and other terms of the Charter Contract; WHEREAS, the Board has thoroughly considered the Renewal Application, the relevant law, Board Policy, the Site Visit Summary, and the Summative Renewal Report; and,
NOW THEREFORE, BE IT RESOLVED the Board finds it in the best interests of the students, School District, and community pursuant to Colorado law to approve the Renewal Application. BE IT FURTHER RESOLVED that the Board directs the negotiation and execution of a mutually acceptable charter contract no later than ninety (90) days after the effective date of this Resolution, unless the parties jointly waive such timeline pursuant to C.R.S. § 22-30.5-106(2). Such contract shall contain standard terms and conditions and will address relevant issues including, but not limited to: ● Alignment with School District and CDE achievement data collection and metrics, including those for alternative education campuses, and plans to increase academic growth with annual updates ● Incorporation of interim assessment data tied to benchmarks and growth targets ● Revised 5 year budget plan with appropriate balances ● Fully participate in the School District’s Annual Performance Review process pursuant to Policy LBD Approved and adopted this ___th day of May, 2026.
