We have one discussion item 6a and this is a authorization for a moratorium on data and detention centers. Yes, good morning commissioners. My name is Ethan Amner. I'm a long range planner with Boulder County Community Planning and permitting and so what this authorization memo is asking for is two things one authorizing a land use code text amendment to the land use code as it relates to data centers into Tetention Centers per article 16 and also authorizing a temporary moratorium to be put in put in place. While staff work to update the land use code to account for those uses I'm happy to answer any questions if you'd like But that's the

Could I just on that I mean we have two different provisions that we're looking at which may end up I don't know if they're going to end up being in the same section of the land use code or different sections So maybe we have four things we should be voting on it. Does it matter. So let's see let me just think out loud so we have data centers code updates authorization and then we could say detention study is code update authorization I think you could do those separately or together whatever's most clear and then more Torium on both on both. Thank you Okay, and I just wanted to say for the record that you know we did as Commissioner Lushman said have some discussion about the need to update our language code on these two provisions dealing with data centers and Detention centers because we don't appear to have anything that really explicitly applies to those two different very different land uses and Big because they you know arguably there could be some provisions that would allow those uses Uh, without providing an avenue for adequate consideration of the impacts that they may have We did Deen necessary to update

0:04:43the land use code and just because that may take some time Um, possibly six months it'd be prudent to put a moratorium in place so that we can make sure that if any applications came forward they would be considered with all the appropriate Um, impacts in mind So that's just a little more background on why we are going forward So I think we do have a resolution in the packet that doesn't have a number But Commissioner Stolzman I think you can probably just go ahead and craft a motion and then staff can bring us back Uh, for formal adoption? Would we do that at a subsequent meeting or is this it? Do we need this resolution or another version of it? If we wanted to go into place today you could approve it today Um, I believe we could just get it signed Um, and get a number. If you want to come back to you We could do it that way too But the idea was that we would put it in place today if you so choose and then come back for a public hearing in 30 days Okay And at that point you could decide whether you want it to stay in place for the full six months or terminate earlier modify it. I'll move that the Board of County Commissioners authorizes staff to amend the Boulder County Land Use Code as it relates to Detention Centers. Second. I Will make a motion to approve a resolution Uh, putting a moratorium in place on accepting land use applications related to data centers. And do we have to specify a duration for that moratorium. I think we're authorized for up to six months while we're working, is that correct? That's correct In the draft includes a date six months out from today. Alright, so then that would be the motion would be to approve a moratorium on data centers for a period up to six months from today's date. And I just have a question on that motion. The resolution that's in the packet on page 21 says data and detention centers and what I heard of the motion would be for data centers And so. I might Would staff just break those out into two different resolutions It looked like

I think as long as I mean I think the motion as structured What allow one more Torium to be lifted before the next, just because it's for as long as is needed to adopt new land use regulations, right? And I will kick us off Uh, the Boulder County Commissioners recognized June as gun violence awareness and Prevention Month in Boulder County We recognize this month to raise awareness of the ongoing harm of gun violence We also recognize this month to emphasize the need for partnership between local state and federal governments to protect the lies of our residents through common sense firearm regulation. We encourage residents to join us in honoring the lives of victims and survivors of gun violence, and in building community awareness I'm sorry, building community to prevent gun violence by wearing orange on national gun violence awareness day Which is Friday June 5th, and where orange weekend June 6th and 7 We make this proclamation because the United States suffers from an epidemic of gun violence Unparalleled in any other developed nation Almost 40, 000 people died as a result of gun violence last year, and the United States ranks highest of all wealthy nations for gun -

0:10:51related deaths Gun violence Prevention is also a matter of racial equity firearm - related dust continue to be the leading cause of death among children and adolescence to the United States with black and Latino children more likely to be harmed or die from gun violence than white children due to systemic racism. Irreas with disproportionately high rates of shootings often experience poverty, which is tied to inequality segregation and racism Gun violence impacts all of us Almost two - thirds of adults report that they or someone they know or care about have experienced gun violence in their lifetime So aside of the largest share of deaths related to firearms followed by homicides and accidental shootings. It doesn't have to be this way Commonson's gun violence prevention policy saves lives Data from the centers of on disease control demonstrate that states with stronger gun laws have fewer deaths Which is one of the reasons Boulder County Commissions passed Boulder County Ordinances to prevent gun violence in 2022. We have consistently supported and continue to support an assault weapons ban Boulder County passed an ordinance prohibiting the manufacture, import sale, or transfer of assault weapons in the county A statewide or national ban on assault weapons is essential to keeping our community safe And we condemn efforts by the federal government to attack sensible state and local limitations on

0:12:14assault weapons During this year's legislative session in Colorado, we supported the following thesis of legislation Which were passed by the legislature. Prohibit three - dimensional printing firearms and components Which was HB 26 - 1144 which bans un - serialized firearms and unfinished frames, also known as ghost guns The law explicitly prohibits 3D printing a firearms and firearm components Expand the list of petitioners for protection order and extreme risk protection order is a similar court order issued by a judge that temporarily restricts a person's access to guns When they're found to be a risk to themselves or others, Senate Bill 26004 adds mental health emergency response personnel and institution such as hospitals and schools to the list of people and organizations that can submit a petition to the court for an extreme risk protection order In law enforcement national electronic tracing system and share program HB26 1265 requires law enforcement agencies to register and share data within the National Firearms Electronic Tracing System This proclamation is dated June 2nd 2026.
