We have all three commissioners present. And we are here for our monthly public comment session. And the way we do this is we take public comment in the order in which people have signed up for about 50 minutes and reserving the last 10 minutes for commissioners to respond, have their own comments if they wish. 0:01:32Go last. Yeah, we can accommodate that. Okay, so then the next person is Michael Barrow. Mike Barrow, live in Lafayette. Want to speak to you this morning about the alternating day bike ban pilot project today? I want to shift that focus, however, to talk about what drove this commission to take such an action. It was, of course, the user experience. It sucks to be a hiker on Heil's Wapatee Trail when you encounter a Mountain Biker coming down. It's been that way since October 2001, when the trail was opened, I should know I was there and I said so. That was 25 years ago. I was representing Mountain Bikers during the planning stages of the North Foothills Open Space Master Plan in the mid - 1990s. The trail placement was dictated by resource staff that held the belief that Eddie Trail was an environmental sacrifice. Humans are bad and we must protect this resource at any cost. That's an extreme description, but you get the drift of the bias. To get to the Wapatee Trail, open space puts users on a road for a half a mile. Suffice it to say that the user experience was never a priority in this plan. Now comes along the May 26 Open Space Work session, Presentation. As a person who is engaged open space on management plans since the
0:03:15early 1990s, I was intrigued by this new approach. But concerned that the engagements of years passed would be forgotten. Then North Foothills Open Space Plan was approved in 1996. BMA Prespace hard on a revisit to the plan around the 2010 timeframe. Because we were told that no changes to the trail plan could happen without a formal reopening of the plan. Then in 2013, we had a fled followed by fires. And any positive momentum disintegrated. Add the major departure of senior staff in the last year, and maybe yes. It might be time to take a different approach to management planning. Maybe we have a new generation of staff who don't take a, who don't look at recreation as a threat, but an opportunity to create sustainable that actually addresses the user experience as while protecting sensitive resources. It can be done, but we need elected officials who don't see recreation as a threat. And the will of the community to do it responsibly. When closure is the first tool you take out of a management toolbox, it's unacceptable to the affected group and a blow to the partnership Boulder Mountain Bike Alliance and Mountain Bikers have built with Boulder County over the last 35 years. 0:05:03Eric Sweeney. I live in El Dorado Springs. Please reconsider your decision to limit home size in the town sites, 1, 500 square feet. And went back to the original source documents for when the town site neighborhood category got created. I want to talk about three things. The invitation TDRs and the planning draft. First, the planning department sent a letter to all Elder Rage Springs residents June 2008. It was an invitation. Let me read a few sentences. County commissioners are inviting several communities to participate in a community planning process. And if there's interest in exploring and participating in a community planning process, the County will convene a community - wide meeting to engage the whole community to determine its level of interest. It's signed by Dale Case, Gary Sanfordson. It's an invitation. The whole townsite process was voluntary participation was never meant to be penalized. Second.
0:06:14In August 2008, the County Commissioner has passed the transferred development rights program. The town site neighborhood category was created indirectly through that. It did not exist before. I listened to the meeting where commissioners toured Domenico and Pearlmen passed a TDRs and their discussion. They chose 1, 500 square feet as a placeholder for the town sites. They were adamant about a subsequent planning process where each town site would choose the right home size for their community. The commissioner has established 1, 500 square feet as the floor. Your decision turns it into the ceiling. You've used that number in a way that was never intended. Third, Elder Osprings took the planning process seriously. It was a three - year process with hundreds of hours spent. We submitted a final draft to planning May 2011. They edited and completed a polished draft February, 2012. Unfortunately, that draft got put on permanent hold. That's where it is today. After all, that work, nothing ever happened. None of the benefits promised were delivered. It was a huge letdown. Now you've taken the town site designation and the broken promises that went with it and weaponized it. Inclusing one size did not fit all, especially in the town sites. Your decision doesn't fit some problem in the town sites, just the opposite. I'm sorry, it doesn't fix some problem in the
0:07:52downside to just the opposite. Please go back to the previous system. It was working exactly as the founders intended. If you want more certainty, then ask planning to send you the 2012 document. It's a precise floor area rational plan. Taylor De La Roder Spring? Yeah, thanks. I heard about the recent meeting with the Lions BOT about pesticides. Obviously Lions is an official B City and is protected. But the bees also frequent Countylands such as Red Hill. Pesticides already destabilizing tool as is war. Is your decision to continue destabilizing or drawing the majority of lionites and commit to regenerating? As you know, POS Aerial sprayed my neighborhood without notification. And it was an off - label use. The town of Lions has given you the ecology board's IGA violation report. And I sent that to you as a reminder. Community members and affiliated neighbors worked with you and staff for two years to ensure this horrific helicopter assault in the injuries that cause never happened again. However, you kept Rejuva and drone spray, even though more than 80 percent of citizen surveyed were against this industrialization practice. POS misreviewing the 2007 1013 16 1922. 0:09:36that was ignored. Two of you are allowing immunity from accountability by letting Ariel spray continue. That's a pattern here that's similar to the Trump administration's behavior in regards to Pesticide liability shields. Protection for the deceptive and never admit you're wrong. With the CDA complaints still open investigating unpermitted research and testing relations to the quantity frequency and sites within DASAM, Esplanade, glyphosate. We're used in testing of the new concoction called Rejuvera as far back as 2014. The FIRE report by SOSVV shows nine of 12 testing sites sprayed with petrochemical concoctions that I mentioned above experienced wildfires within 12 to 18 months of the spray. In your own words, POS staff in their own words, they admitted that Boulder's ground zero for research and testing of Rejuvra. Remember you and Possac did not know that they were experimenting. All you have to do is make the moratorium arrow spray. Permanent. Dr. Tim Ced has studied cheat grass for almost 20 years and discovered that she grass is nationally going away in the front range. And it is an extensive research. Half as many natives returned in sprayed sites. Therefore, the original excuse for sprain, Rejuven, the first place is MUT. Cheek grass is not a fire hazard.

My name is Edward Yagi, and I am co - owner of sixth generation family property in Alan's park. Last year, Boulder County began illegally imposing new on - site water treatment system related vacation rental licensing requirements and a new 1000 dollar change of use fee with no legal authority, no due process, and no evidence that the fee was based on actual administrative costs. Property owners who had complied with every requirement adopted during five years of bitter public debate suddenly found themselves subject to new conditions that appeared nowhere in the published ordinance. Colorado law is clear. CRS 244103 requires regulatory due process. 2510 104
0:12:49limits the scope of OWTS regulation and does not authorize limitless reinterpretation of change of use. 2510 107 and 5CCR 100243 require permit fees to reflect actual cost recovery. T - Board prohibits you from disguising taxes as regulatory fees. Inventing requirements out of thin air, extorting payment, forcing compliance through licensing power and delaying license renewals is the raw definition of abusive authority. At least a dozen people in public health, CPNP County Attorney's Office, and you Boulder County Commissioners were either totally aware of any of this, or you were aware and let it happen anyway. Both are violations of CRS 188404 first degree official misconduct and the common law standard for gross negligence. Every legally collected fee must be returned. Every internal deliberation related to these policies must be disclosed to the public. Those responsibles should be fired or prosecuted, but your legal violations are only half the story. The other half is the conduct of you commissioners. You failed to supervise departments operating under your 30 while unlawful fees, requirements, and delays were imposed on taxpayers.
0:14:10When exposed your response was not accountability, it was evasion. You have ignored questions. You have denied responsibility. Commissioners leavey and loaching especially appear determined to insist the spitey pause last month. You still refuse to explain who authorize these policies, why they were imposed, why multiple laws are violated or when affected taxpayers will be made whole. I asked for basic information on the number of licenses issued with a feasily glee collected. You tell me you need 20 hours to perform five minutes worth of work and want me to pay you 800 dollars in core fees. This is not transparency. This is obstruction of justice. You commissioners have a choice. Continue to cover up and protect the guilty or admit your failures, refund the money and hold individuals accountable and support independent investigation. This is not about septic systems or vacation renewals. It is about the rule of law. Your time is up. Thank you so much.

Um, and I'm speaking to you as a woman who had a career as a child protection attorney, who is a mother and who is now a grandmother. And I have long been concerned about how women can work and have children. My law school, law review article concerned access to childcare so that a parent could attend school. Um, during my legal career, I prosecuted dependency or neglect cases. The civil side of child abuse for 20 years in atoms and Boulder Counties, um, during those years, I raised a daughter and found her high quality childcare so that I could work knowing that she would be well cared for. Our family was fortunate to have the income that made it possible for her to be an excellent programs.
0:19:48Now retired, I provide after school care for my grandchildren. My 20 years of experience working in child protection, the child protection system, um, has turned me into a strong advocate for making sure that we as a society do all we can for young children, especially those age zero to three. Research shows that much of a child's major cognitive and emotional development occurs during those early years. Studies have shown that high quality childcare contributes to the development of children who are less likely to become involved in the juvenile justice or the criminal justice systems. Who have less likely to rely on government benefits and are more likely to have become employed, productive taxpaying citizens. The return on investment in supporting the development of young children is clear. To help children become all that they can be, we need to make sure that all families and children who needed have access to high quality childcare. The cost of child care makes it difficult, if not impossible for all families to access high quality care. You have heard the cost and availability and care in Boulder County and from other sources, the statistics. I'm not going to go over statistics with you today. That's not my, uh, agenda.
0:21:10Um, I just think it is, the universal agreement among parents, early childhood, providers and advocates that much more financial support is needed to ensure that all children receive the care and resources to succeed in life. The state federal and state and federal government funding is not available at this point. I urge you as the commissioners of Boulder County to do all that you can to increase our investment in the support of all young children in Boulder County and consider establishing a dedicated source of funding to make that possible. 0:27:12And I'm here to speak about the updated comprehensive plan this month. Your 10 year guiding document. I want to express a concern that deeply affects this area. As you move towards adapting the updated comprehensive plan and looking at the Boulder County Commission Districts map and how it affects my neighborhood in Stonehenge, especially my property at 2117 Stonehenge Circle in Lafayette, which is in District 3. Stonehenge sits outside the city of Boulder Limits, yet recent decisions and mapping changes push us further out of the 10 year Boulder Valley Comprehensive Planned Framework. For example, you miss areas in district three and other areas. The further you go is at a wrap a whole road. You do not go to the next major street, which is up to Highway 287. These changes are, these changes you are making, leave out many of the neighborhoods as well as mine.
0:28:33It feels like you are overlooking and excluding the constituents you are supposed to support. I also have a direct question for you. Why are certain areas like ours being left out of the comprehensive plan, which you are actively seeking more affordably and availability in housing. Stonehenge is in district three, yet only part of the district is being included in planning considerations. When you pick and choose which portion of the district receives attention, resources, or representation, it creates unequal treatment. For residents like me, it feels like discrimination against the very constituents you are meant to serve. For more than 50 years, the City of Boulder and Boulder County have jointly adopted the BVCP and shared commitment. The guiding responsibility land use to preserve the distation between urban and rural areas and to collaborate all of the areas where city and County interest overlap. When Stonehenge is left out of the collaboration, it's undermines the purpose of the plan and promise of equal consideration. Our community, I just have one more sentence. Our community deserves the same planning attention service access and long - term vision as other neighborhoods within the County influence. Thank you very much.

And also, I think you want to address that too. Appreciate folks, um, coming in to speak here in person and also the emails and other public comment opportunities that we have, um, to hear input and ideas and suggestions. I'm just, there was a couple last month we had, um, I think 20 some people. So we didn't get through everybody and we didn't have chances to respond. And there was a couple of pieces on that one as well as today. And so I think for me, a lot of times I'll be in this hearing room and I'll hear something, Oh, I didn't even know that was going on or it was a situation that I hadn't heard yet through a meeting that was already scheduled and we hadn't got there. So that is very helpful. There's a couple of the comments today that we're repeat of last, um,
0:31:34of last month. And I just wanted to follow up in regards to the childcare question. There was a couple of people that spoke to that. My understanding is that a potential initiative, the polling has been completed, which is an update since last, um, our last meeting here, um, and that it looked really positive. So I am, um, anticipating a meeting with the Board of County Commissioners later to have that conversation. So I just wanted to give that as an update. And that's something that I'm looking for and listening to. And then there was a couple of questions in regards to both in May and then today on the on - site water. Oh, what did I write it down? Um, system, but meanwhile, we've gotten an email from public health. And we actually have a meeting, a joint meeting with the Board of Public Health today this afternoon. And so that was just put on my notes of a conversation to just check in with that board in regards to that question. Um, and I know the emails and conversation, including folks with the state in regards to that topic. Um, and then I think, um, there were some questions again in regards to just investments of Boulder County. And because the county is really mandated by the state in regards to the ways that
0:32:54we do our investment we have had our Boulder County treasure come in and just give some information. So I would suggest if it folks do have questions about any of the investments that the county does, um, that the treasurer's office would be a great place. It was looking online really quick just to see if there might be a reference. I didn't see anything in there, but their office is really great about providing information if folks have questions on that. And then the comprehensive plan specific piece that you had on there, Janine, I wasn't familiar with the question that you had on Stone Hedge and District 2. But I was wondering too, if you looked like you had written comments that you read from, you might want to just leave those with Natalie. And she can share that with the full board too. 0:33:36Thank you. Thank you, Commissioner. Thank you, Commissioner. Just a couple of things to add, um, double up on. Just wanted to make a comment around, um, the Boulder Valley comprehensive plan really being a city of Boulder Exercise where we work with them in the Boulder Valley area. And, um, we can look at different areas and changing it that hasn't been done this time, but we, I just want to make sure you're aware that we also have the Boulder County comprehensive plan for everyone in the county that is the creature of the County. So just a small point, but your point is still well taken. Just a point I wanted to call out. Um, still working on the vacation rental issues. I just wanted to say that. Um, looking, I'm very much looking forward to the discussion on biking and hiking. We've gotten many proposals, um, that would help with safety and user experience for both bikers and hikers and other types of users and nature.
0:34:28So thank you for the proposals, particularly the number of interesting proposals for Wopity. So thank you for that in the history on that also. Just shifting gears a little bit. I just want to take a moment to denounce anti - Semitism that's become all too common in public spaces in the city of Boulder. Murdering Jews in our community is not acceptable. And the sentence that DA already secured against the murdering and burning and attempting to murder and burn Jews in our community represents justice for our entire community, including the Jews. Including the victims and including the survivors. Our community needs to stand upright at this time, not just for the Jews, but because we're allies, we're neighbors and we need to call and end to hateful speech and anti - Semitic speech. Hateful speech leads to hateful actions. It may go without saying for some in our community, but I find myself at a place in 2026 that I need to remind the community that Jews are people. As it's important for the entire community to stand against hate, it's equally important to recognize that we need to take a moment and call out whether our government, our local government, our state government, um, is supportive of different community members. So I'll take this moment to recognize that our local government is essential to protect
0:35:44health and safety and that we are interested in uplifting community members, including the Jewish community. Our local government supports the Jewish community and will stand up each time and stand against the dehuman dehumanization of Jews and violence toward Jews. Thank you. Okay. Thank you, Commissioner Lord. I appreciate those comments. Um, I guess they're just a couple of things that I want to speak to, Mr. Barrow. Um, you know, what I was hearing in your remarks is an assumption that our staff is anti - recreation. And, uh, and so the North Foothills master plan, um, is city aboulder open space mountain parks. That's not our county master plan. Um, Space plan is high. At hall. Okay. I apologize. I was thinking of the sky. Sorry. Trail. Okay. Um, but just the point I wanted to make is that our open space mission values and vision reflect a balance between all the different values that we, uh, are trying to protect when we purchase open space. And the highest value and the reason we buy much of the open space that we buy is to protect ecosystems and have them intact and prevent them from being fragmented and destroying the habitat that exists on those lands, especially when we're fortunate enough to buy such large tracks as high all and hull. Um, recreation absolutely has a place
0:37:31on our public lands, but we try to, um, try to plan that, uh, the trails so that it does not undermine the most valuable resources on that land. So, you know, if it, if it leaves the perception of being anti recreation, I think it's, it's, um, a perception and not really the reality in that the planning has to take into account elk calving grounds, um, eagle nesting sites, et cetera. And I think we do try to accommodate recreation to the extent we can. Mr. Sween, I appreciate all the research that you've done. And I would appreciate, um, if you have documents that you are referring to, I would appreciate seeing those, um, because I'm still not completely satisfied with, um, what, what I understand, uh, of the, uh, origin of the 1500 foot limitation. So I would be interested in looking at that further. Um, I think, um, Commissioner Stolzman and Commissioner Loumine addressed the OWTS situation that we did bring that to the attention of, um, the director of public health, uh, their reexamining that decision and determination. And we're watching that and as Commissioner Loaching, we said we are meeting with the Board of Health this afternoon for a retreat. Janet, I'll say again, just, um, uh, reinforcing Commissioner Stolzman's comments, uh, the boundaries of the Boulder Valley comprehensive plan haven't changed in
0:39:16probably the 50 year history of the plan. And that is just a recognition of the primarily is Boulder, City of Boulder's master plan is their only master planning document. And then it reflects areas in which there are mutual interests around the periphery of the City of Boulder, but as Commissioner Stolzman said, the Boulder County comprehensive plan addresses the entire county. And for areas that are outside the boundaries of the Boulder Valley comprehensive plan, we look to the Boulder County Count plan. So since you are within the Municipal Boundaries of the City of Lafayette, we really have very little, um, direct, um, influence on your neighborhood. I know we're, we're doing some, um, transportation planning projects in the area, trying to, uh, address the lack of sidewalks and safe crosswalks and all of the stuff at the intersection of, I think it's 95th in a wrap ho. So we're doing that in conjunction with the City of Lafayette. But I just don't want you to be concerned that not being within the Boulder Valley Comprehensive plan that your neighborhood is not, you know, being attended to.
0:40:34So it's just a different, different plan. I don't have any prepared remarks about the pretty vial anti - Semitic comments that were made. And I don't want to speak extemporaneously because I'm, may say something, uh, that I regret or that may be misconstrued. Um, I am always concerned when I hear language, like your people, um, that assumes that everybody with Jewish identity, um, Muslim identity, any kind of identity, I'm Jewish. It holds all of the traits and identities and everything of a people. I am very proud of my Jewish heritage. I am an individual. And I have my own individual. Viewpoints. And, um, nobody, regardless of their color, their cultural heritage, their religious heritage should be referred to as you people. Um, and so that, that is dehumanizing. And, um, you know, I, I don't think that belongs in the public space. So, um, I think that's all I want to say about that. Uh, I think we've had Commissioner Lochimin. Go ahead. Yeah. One, and of course, Mike just left, but I did get a chance since May since some of the first conversations on this trail question and alternating use.

Um, in reference to June 1st and what that means for us here in Boulder County and the City of Boulder. And I just want to publicly, um, denounce anti - symitism alongside my commissioner colleagues and our staff here, Boulder Boulder County and this community.
