AN ORDINANCE AMENDING TITLE 4, “LICENSES AND PERMITS,” B.R.C. 1981, ALLOWING FOR FESTIVAL LIQUOR LICENSES AND PERMITS AND ESTABLISHING RELATED APPLICATION FEES; AND SETTING FORTH RELATED DETAILS

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO:

9 Section 1. Section 4-2-3, “Authority to Issue City Licenses,” B.R.C. 1981, is amended to

Section 2. Section 4-2-7, “Term and Renewal of City Licenses,” B.R.C. 1981, is amended to read as follows: (a)

With the exception of permits associated with an event, tThe term of the city license issued under this chapter is twelve months from the date of issuance.

(b)

Applicants for renewal of city licenses shall apply to the Beverage Licensing Authority on or before the forty-fifth day prior to the date of expiration of the license.

The authority shall have the authority to issue festival liquor permits pursuant to the provisions C.R.S. § 44-3-404(1)(b)(festival permits), and the provisions of this section. The provisions of this section shall be considered in addition to all other standards applicable to the issuance of licenses under the Colorado Liquor Code (C.R.S. § 44-3-101

et seq.), and any rules implementing the Colorado Liquor Code for festival permits. A person authorized by state statute to apply for a festival permit must also obtain a festival liquor permit from the city before serving alcohol at a festival in the city.

(b)

Qualified licensees wishing to receive a festival liquor permit must pay the required application fee and submit an application on forms prepared and furnished by the city stating such information as the authority may require enabling the authority to determine whether the proposed festival liquor permit can be held without violating the provisions of this chapter or any applicable state law or rule and without creating a public safety risk to the neighborhood.

(c)

After accepting an application under this section, the city clerk or designee shall process the application pursuant to the authority rules of procedure. Approved applications are valid for the dates therein on the application.

(d)

The authority may deny a festival liquor permit or supplemental application for any of the following reasons:

(1)

The location where the festival is to be held is unsuitable due to time and proximity of other inhabitants of the area that would be adversely impacted;

(2)

A documented history of violations of the Colorado Liquor Code, the Colorado Beer Code, the rules issued pursuant thereto, or violations of the city liquor code by any participating licensee;

(3)

If the issuance of the permit would be injurious to the public welfare because of the nature of the festival or its location;

(4)

The filing of an incomplete or late application; or

16

(5)

A finding that the application, if granted, would result in violations of the Colorado Liquor Code, the Colorado Beer Code, the rules issued pursuant thereto, or violations of the city Code.

Section 4. Section 4-20-2, “Alcohol and Fermented Malt Beverage License and Application Fees,” B.R.C. 1981, is amended to read as follows:

Each applicant for a hotel and restaurant license or an entertainment and tavern license shall pay a manager registration fee of $30 to the city.

(c)

Each applicant for a fermented malt beverage license shall pay the appropriate Alcohol and Fermented Malt Beverage License and Application Fees, application fee, as follows:

Section 5 . This Ordinance is necessary to protect the public health, safety, and welfare of the residents of the city and covers matters of local concern.

Section 6 . The City Council deems it appropriate that this Ordinance be published by title only and orders that copies of this Ordinance be made available in the office of the city clerk for public inspection and acquisition.
