DEED OF VACATION The City of Boulder, Colorado, does hereby vacate and release to the present owner of the subservient land, in the manner prescribed by Section 43-2-302, C.R.S., a portion of Colorado Avenue previously conveyed to the City of Boulder and recorded in the records of the Boulder County Clerk and Recorder at Book 1270 at Page 240 on the 11th day of March, 1963 located north of 1100 28th Street and more particularly described in Exhibit A attached hereto and incorporated herein by reference. Notwithstanding the foregoing, the City reserves an easement for the installation, construction, repair, maintenance and reconstruction of utilities and appurtenances thereto, together with all rights and privileges as are necessary or incidental to the reasonable and proper use of such easement in and to, over, under and across the real property described in Exhibit A attached. No permanent structure or improvement shall be placed or authorized to be placed on said easement by the owner of the subservient land or its successors and assigns, and the use of such easement shall not otherwise be obstructed or interfered with. The above right-of-way vacation and release of said right-of-way located north of 1100 28th Street shall extend only to the portion right-of-way specifically vacated. The within vacation is not to be construed as vacating any rights-of-way, easements or cross-easements lying within the description of the vacated portion of right-of-way nor as vacating the within reserved easement referenced above. Executed this _______ day of ________________, 2026, by the City Manager after having received authorization from the City Council of the City of Boulder, Colorado, pursuant to Ordinance 8742, adopted by the City Council of the City of Boulder, Colorado.
