BOULDER VALLEY SCHOOL DISTRICT RE-2 RESOLUTION 26-07 On the Summit Charter School Renewal Application WHEREAS, the mission of the Boulder Valley School District is to create challenging, meaningful and engaging learning opportunities so that all children thrive and are prepared for successful, civically engaged lives; WHEREAS, on October 12, 1995, the School District and Summit Middle School Program Charter School entered into a Charter School Contract; WHEREAS, the Charter School Contract was renewed for additional terms commencing on July 1, 2001, July 1, 2006, and July 1, 2016, with the current term ending on June 30, 2026; WHEREAS, pursuant to the Charter Schools Act, C.R.S. §§ 22-30.5-101 to 120 (the “Act”), the Board received a Renewal Application ("Renewal Application") (attached as Exhibit A) from Summit Charter School for a renewal to commence as of July 1, 2026 in accordance with the School District’s Board Policy LBD; WHEREAS, Summit has achieved pupil performance standards, responsibly managed its funds, and substantially met all other goals, objectives, content standards, applicable federal requirements and other terms of the Charter School Contract; and, WHEREAS, the Board has thoroughly considered the Renewal Application, the relevant law, Board Policy, the Site Visit Report, and the Summative Renewal Report. NOW THEREFORE, BE IT RESOLVED the Board finds it in the best interests of the students, School District, and community pursuant to Colorado law to approve the Renewal Application. BE IT FURTHER RESOLVED that the Board directs the negotiation and execution of a mutually acceptable charter contract no later than ninety (90) days after the effective date of this Resolution, unless the parties jointly waive such timeline pursuant to C.R.S. § 22-30.5-106(2). Such contract shall contain standard terms and conditions and will address relevant issues including, but not limited to: ● Commitment to increase the enrollment of students with disabilities across disability categories to proportionality with the School District’s overall population and further progress towards demographic parity with updates reported annually ● Increased attention to growth for multi-lingual learners with updates reported annually ● Alignment with open meetings and financial records transparency, particularly including fundraising ● Licensure and qualifications of leadership and educators ● Alignment with School District student discipline and program data collection with disaggregation across student groups
● Alignment with the School Board’s open enrollment preference criteria (Policy JECC and JECC-R) ● Non-automatic waivers from state statutes and School Board policies only for those items that have replacement policies ● Fully participate in the School District’s Annual Performance Review process ● A five-year term with no automatic renewals Approved and adopted this ___th day of February, 2026.
